The five basic types of subrogation claims in Colorado: A subrogation checklist
1. Automobile accident
a. Payment for permanent injuries and lost wages after 52 weeks always recoverable.
b. Medicals and first year of lost wages (no-fault equivalents) only recoverable if:
(i) Accident involves commercial vehicle.
(ii) Uninsured at fault driver.
(iii) Insurance carrier not licensed to write insurance in Colorado.
2. Premises liability (slip & fall)
3. Premises liability (medical malpractice)
4. Product liability (equipment or heavy machinery involved)
5. Assault and other physical crimes against the person
